1. Purpose
(“ZipBy”, “we”, “us” or “our”) values your privacy and uses this application or website and all of its related webpages and websites (including without limitation any mobile optimized website) to provide you with access to ZipBy’s products and services (collectively, the “ZipBy Platform”). The purpose of this privacy policy (the “Privacy Policy”) is to describe how ZipBy collects, protects, uses and discloses Personal Information that is collected by ZipBy or provided by you as you use the ZipBy Platform.
This Privacy Policy is hereby incorporated into:
(a) our Website Terms and Conditions;
(b) our Mobile Payments Terms of Use Agreement; and
(c) any other agreements with ZipBy into which you may enter from time to time (collectively, the “ZipBy Agreements”).
This Privacy Policy may change from time to time, so please check periodically for updates.
2. Information Collection, Use And Disclosure
Personal Information
For the purpose of this Privacy Policy, “Personal Information” means information about an identifiable individual (including any “Personal Information” as such term is defined in the Personal Information Protection and Electronic Documents Act (PIPEDA) in Canada, the Personal Information Protection Act (PIPA) in British Columbia, Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth) in Australia, the General Data Protection Regulation (GDPR) in the European Union (EU), and applicable United States and Californian Privacy Laws), that is collected by us or supplied to us through the ZipBy Platform in order to operate and use the ZipBy Platform. See “Information We Collect” below for a more detailed list of the various reasons why ZipBy collects Personal Information.
Information We Collect
To take advantage of some of the features of the ZipBy Platform, you will have to provide us with your Personal Information. You are responsible for ensuring that all information created through your use of the ZipBy Platform and any of our services is accurate, reliable, and complete.
We collect, receive, and may store Personal Information. Personal Information may include your full name, username, phone number, email address, residential address, billing address, shipping address, credit card information (including the credit card number, expiration date, and the full name on the credit card), billing history, trip history, geographic and location information gained through the use of the ZipBy Platform.
We may also collect other supplemental information from various third parties. For example, if you incur a debt to ZipBy, we may conduct a credit check by obtaining additional information about you from a credit bureau, as permitted by law; or, if the information you provide cannot be verified, we may ask you to send us additional information, such as your driver license, credit card statement, or utility bill, to confirm your address, or we may ask you to answer additional questions on our website, via email, or through our customer service centers or programs.
If you do not wish to have ZipBy collect your Personal Information through the ZipBy Platform, you can choose not to provide us with your Personal Information, but that may impair your ability to access and use the ZipBy Platform.
When you download, access, and use the ZipBy Platform, information that does not identify you may be collected by ZipBy or our service providers to customize and improve user experience, improve our applications and services, understand usage and navigation trends in the aggregate, determine the relevance of content, and for other planning and evaluation purposes. The information automatically collected is not linked to your Personal Information. In particular, we may collect:
(i) Website Details: Google Analytics or other analytics providers may also collect information about the parts of the ZipBy Platform you use or third-party websites you visit when you leave the ZipBy Platform;
(ii) App Usage Details: When you access and use the ZipBy Platform, we may automatically collect certain details of your access to and use of the ZipBy Platform, including location data and other communication data and the resources that you access and use on or through the ZipBy Platform; and
(iii) Other information: We may collect information about your IP address, operating system, browser type, mobile network information. Note that IP addresses may also be linked to Personal Information, to improve your experience while you are using the ZipBy Platform.
Information may be collected by using cookies or mobile cookies, or related technologies. A cookie is a small file placed on your computer, smartphone, or other device. It may be possible to refuse to accept cookies or location-based capabilities on your device by activating the appropriate settings. However, if you select these settings, you may be unable to access certain parts of the ZipBy Platform.
When installing or operating the ZipBy Platform, the application or operating system may display default notices indicating or requesting access to photos, media, files, or contact lists. Please note that ZipBy does not access any such information on your device. ZipBy does not access any files on your device except a local log file that documents your activity within the ZipBy Platform only. This log file is stored on the same memory space as your photos and music, and the operating system and therefore may require such notices to indicate that we have access to that general memory space. Additionally, this log file does not track your activity in any other application, nor does it contain data pulled from any other function on your device. We access the log file when you submit a bug report. The data in the log file allows us to reproduce, and ultimately fix, bugs that you may encounter during your use of the ZipBy Platform.
How We Use Collected Information
We may use any Personal Information provided by you to serve you and to operate and maintain our services. For example, we may use Personal Information to manage the products and services we provide to you, manage your account with us, respond to your requests and inquiries, to customize your future use of the ZipBy Platform, to troubleshoot problems with the ZipBy Platform, to improve the ZipBy Platform, to enforce the ZipBy Agreements, to conduct marketing (including promotional activities), to conduct surveys, to communicate with you, and to take any other action required or permitted by law.
Note: We do not use Personal Information that identifies you for any marketing purpose unless we have given you the opportunity to consent or withhold consent to such use, in which case we will honor your choice.
By providing Personal Information through the ZipBy Platform, you acknowledge and agree that we may use the Personal Information for the purposes set out above.
When We May Disclose Information
We may use third-party companies to provide us with back-end support for the ZipBy Platform and our services, including, but not limited to, our mobile parking payments service, data storage and processing, web hosting, and credit card processing. We reserve the right to partner with any third-party service providers, and we may share Personal Information with those third parties to allow them to provide services. We also may exchange information with other companies and organizations for fraud protection and credit risk reduction. We will not transfer Personal Information to such third-party service providers, except for our business partners who have agreed to comply with legally required privacy standards and who will use the information only for the purposes disclosed at the time of collection or for a use consistent with that purpose. Note that your Personal Information is not disclosed to parking enforcement officers who enforce parking bylaws.
We reserve the right to and may also disclose Personal Information that we believe is necessary or appropriate:
(i) to enforce our rights under the ZipBy Agreements, or any other agreements;
(ii) to investigate or defend against any allegation or claim against ZipBy or involving the ZipBy Platform or our services;
(iii) to assist governmental enforcement agencies or if we reasonably believe that we are required to do so by law or legal process or if we are otherwise requested by any law enforcement officer or agency acting under color of law; and
(iv) to protect the property rights and safety of anyone (e.g., if you are in an accident and are unable to communicate Personal Information to the appropriate authorities, we may provide Personal Information to the authorities). We also may release Personal Information if required to do so by agreement, or if in good faith it is necessary to comply with any agreement.
We may also share Personal Information, at our discretion, to the extent that such information is not readily personally identifiable, including, without limitation, with researchers or the public, such as data challenges or other public disclosures of data that is not readily identifiable.
Retention of Personal Information
We may keep Personal Information obtained through the ZipBy Platform for so long as is necessary or appropriate to carry out the purpose(s) for which such information was collected or for such longer period as may be required or permitted by applicable laws and regulations and your consent to such purpose(s) remains valid after termination of our relationship with you.
Although we have no obligation to do so, we also may retain any email, letter, or other correspondence from you, to ensure quality control.
3. Safeguarding Your Information
We take reasonable security precautions to protect your Personal Information. When we ask users to enter sensitive information (such as a credit card number), that information is encrypted. We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration and disclosure. Your PIN protects your mobile pay parking account information from unauthorized access and you are responsible for keeping this information confidential. We ask you not to share this information with anyone. Specific security features include:
(i) your account locks after three failed attempts to access it;
(ii) only your parker identification is retained on your mobile device, and all other information stays on our service providers’ dedicated servers;
(iii) all communications are encrypted; and
(iv) we have required our providers to ensure that payment transactions are protected to Payment Card Industry Data Security Standards (PCI DSS).
If you have any questions about the security of the ZipBy Platform or about our services, you can send an email to support@zipby.app. Although we intend to use reasonable security safeguards to protect the security of Personal Information, WE HAVE LIMITED CONTROL AND WE CANNOT PROVIDE OR GUARANTEE COMPLETE SECURITY OF ANY PERSONAL INFORMATION, INCLUDING, BUT NOT LIMITED TO, ANY PERSONAL INFORMATION THAT IS PROVIDED TO THIRD PARTIES, THEREFORE, YOUR POSTING OR TRANSMITTING OF ANY PERSONAL INFORMATION IS DONE AT YOUR SOLE RISK. If there is a serious breach in the security of our services, then we will attempt to contact you using some or all of the Personal Information you have provided to us, to allow you to take further steps that may be necessary to protect your information. We will also take steps to promptly notify the appropriate governmental agencies.
4. Links To Other Sites
The ZipBy Platform may contain links to other websites. Please be aware that we are not responsible for the privacy practices of any other website. We encourage our users to be aware of when they leave the ZipBy Platform and to read the privacy policy of every website that collects personally identifiable information. This Privacy Policy applies solely to Personal Information collected by ZipBy.
5. Policy Regarding Children
We do not knowingly collect or maintain any Personal Information from any person under 16 years of age, and no part of our services or the ZipBy Platform is communicated directly to any person under 16 years of age, except through the person’s parents or legal guardians. If we learn that Personal Information of any person under 16 years of age has been collected without parental or guardian consent, then we may take appropriate steps to delete that Personal Information. If you are under 16, you may use the ZipBy Platform and our services only with the involvement of a parent or guardian.
6. ZipBy Changes
As we continue to develop our activities, we might sell or buy assets, subsidiaries, or business units. In such transactions, customer information generally is one of the transferred business assets. If we are restructured, or otherwise change our legal or ownership structure, we reserve the right to assign or transfer any Personal Information that we have collected, provided that the information disclosed continues to be used for the purposes permitted by this Privacy Policy by the entity acquiring the information.
7. Updates and Changes to Privacy Policy
At any time and from time to time, we may unilaterally amend, modify, or change this Privacy Policy at our sole discretion. Notice that if this Privacy Policy is amended, modified, or changed by ZipBy, it will be given to you by either:
(i) a posting of a notice on the ZipBy website;
(ii) an e-mail to you; or
(iii) by in-app notification.
By continuing to use the ZipBy Platform or any of our services after any amendment, modification, or change notice was provided, you have agreed to be bound by all such amendments, modifications, and changes. Therefore, please carefully check the ZipBy website and provided e-mail address on a regular basis to maintain awareness of all amendments, modifications, and changes to this Privacy Policy. If you choose to use the ZipBy Platform or any of our services, your use and any dispute over privacy is subject to this Privacy Policy and the ZipBy Agreements.

Terms & Conditions
1. Introduction
- In this document, ‘we’, ‘our’ and ‘us’ means TMA Technology (AUSTRALIA) Pty Ltd (ABN 57 619 209 899) or any of its related bodies corporate (as that term is defined in the Corporations Act 2001 (Cth)) and ‘you’ means any person who uses the ZipBy application.
- In this agreement “Services” means the provision of the ZipBy application and the services we provide to our customers using the ZipBy application.
- This agreement outlines the terms and conditions that apply to your use of the Services.
- You must also comply with our Privacy Policy and our Acceptable Use Policy as referred to in this agreement.
- Specific Country Privacy Policies can be found within the App under Privacy Policy menu item.
2. Term of Agreement
- This agreement commences on the date you start using the Services and continues for such time as you continue to use the Services, provided that any provisions of this agreement intended to survive termination or expiry of this agreement will do so.
3. Service Availability
- We will use due care and skill in providing the Services in accordance with this agreement. We do not purport to exclude any statutory guarantees, conditions or warranties imposed by consumer-protection laws that apply to Services we supply. However, we cannot promise that our Services will be continuous or fault-free.
- We will attempt to perform all scheduled maintenance at times that will affect the fewest customers. If scheduled maintenance requires the Service to be offline for more than 30 minutes, we will post details of the scheduled maintenance at least 48 hours in advance of the maintenance. If we need to perform unscheduled maintenance that requires the Service to be offline for more than 30 minutes, we will post details of the event after the maintenance has been completed.
- Our liability to you is governed by clause 6 of this agreement.
4. Passwords and Content
- You will keep any passwords or log-in details used in connection with the Service secure, and you are totally responsible for when and how your account with us is used and the actions of any people you give your password and log-in details to.
- You are solely responsible for your data and any content you use or store in connection with your Service.
- You grant us a licence to use and reproduce all your data and content in order to fulfill our obligations under this agreement.
- You must ensure that you comply with our Acceptable Use Policy terms in clause 19 in relation to any data or content you use or store in connection with your Service.
- You agree that if, in our sole discretion, you are using the Services in a way which is not legitimate, is not in compliance with this agreement or any law, we may suspend, disable, limit, or terminate the Services or deny you access to the Service without notice.
5. Customer’s Warranties, Liabilities and Undertakings
- You indemnify us against, and must pay us for, any loss or damage we suffer relating to:
- the provision of the Service to you; and
- your use, or attempted use, of the Service.
- You indemnify us against (and must pay us for) any costs, including legal costs, relating to your breach of this agreement. However, you are not liable to us for any loss to the extent it is caused by us (for example, through our breach of this agreement or our negligence).
- At the time of entering into this agreement, you are not relying on any representation made by us which has not been stated expressly in this agreement, or on any descriptions or specifications contained in any other document, including any catalogues, website, or publicity material which we have produced.
6. Our Warranties and Liabilities
We accept liability for the supply of the Services to the extent provided in this agreement. We do not warrant that the Services:
- will be uninterrupted or error free;
- will meet your requirements, other than as expressly set out in this agreement;
- will be free from external intruders (hackers), virus or worm attack, denial of service attack, or other persons having unauthorized access to the Services or systems of ours.
Subject to clause 6.4:
- we exclude all liability for indirect, incidental, special and consequential loss or damage of any kind, loss or corruption of data, loss of use, loss of revenue, loss of profits, failure to realize expected profits or savings, and any other commercial or economic loss of any kind, in contract, tort (including negligence), under any statute, or otherwise arising from or relating in any way to this agreement and/or its subject matter;
- the Services are provided on an ‘as is’ and ‘as available’ basis;
- we make or give no express or implied warranties including, without limitation, the warranties of merchantability or fitness for a particular purpose, or arising from a course of dealing, usage, or trade practice, with respect to any goods or services provided under or incidental to this agreement;
- no oral or written information or advice given by us, our resellers, agents, representatives, or employees shall create a warranty or in any way increase the scope of the express warranties hereby given, and you may not rely on any such information or advice;
- our total aggregate liability to you for any claim in contract, tort, negligence, or otherwise arising out of or in connection with the provision of the Services will be limited to the charges paid by you in the 12 months preceding the claim in respect of the Services which are the subject of any such claim. Any claim must be notified to us within 3 months of it arising.
In the event that this agreement constitutes a supply of goods or services to a consumer as defined in the Competition and Consumer Act 2010 (Cth) (CCA), nothing contained in this agreement excludes, restricts, or modifies any remedies or guarantees where to do so is unlawful. To the full extent permitted by law, where the benefit of any such remedy or guarantee is conferred upon you pursuant to the CCA, our sole liability for breach of any such remedy or guarantee shall be limited to the remedies available under the CCA.
7. Suspension and Termination of the Service
We may suspend or terminate your account if:
- you breach this agreement and fail to rectify any remediable breach within 7 days of us notifying you to do so;
- you become insolvent;
- you are declared bankrupt; or
- we are ordered to do so by a court or pursuant to an arbitration award.
In addition to any other rights we may have under this agreement, you agree that we may, without notice to you and without any liability to us, amend, alter, or take down your data or content if we:
- receive an order from a court or other competent body requiring us to do so;
- are directed to do so by the Australian Communications and Media Authority, any other regulatory body or authority, or industry association;
- consider in our sole discretion that you are breaching this agreement including, without limitation, by infringing third party intellectual property rights, or because your data or content is defamatory, illegal, obscene or breaches a person’s privacy.
From time to time we may have to suspend or disconnect the Service without notice or deny your access to the Service during any technical failure, modification, or maintenance involved in the Service. We will use reasonable endeavours to procure the resumption of the Services as soon as reasonably practicable. In these circumstances, you will remain liable for all charges due throughout the period of suspension.
If your account has been suspended or terminated due to your breach, reactivation of your account will be at our discretion. If we agree to reactivate your account, we will require payment in full of any outstanding amounts owing to us and we may charge a reactivation fee.
In the event this agreement constitutes a supply of goods or services to a consumer as defined in the CCA, and you cancel your Service because we have failed to meet one or more of the consumer guarantees under the CCA, we will refund to you any unused portion of your Service fee and any other amount you have prepaid, as well as any Service fee where the Services provided did not meet the consumer guarantees.
You may terminate your account or any individual Service with us for any reason at any time by contacting our ZipBy Support Service by:
- telephone on 9892 9990; and/or
- sending an email to legal@zipby.com.au
- Any fees you have paid us prior to your termination of your account are non-refundable except as set out in clause 7.5 above.
If we wish to terminate your Service for reasons other than a breach of these conditions, we may do so by giving you 7 days written notice. In this circumstance, we will refund any remaining unused credit on your account.
If your account is closed for whatever reason you must pay all outstanding charges immediately.
8. Fees, Charges and Payments
- The Service facilitates the payment of fees to third parties such as car park operators. We are not responsible for and have no control over the services provided by those third parties or the fees they charge. We disclaim any liability for the services provided to you by third parties in connection with the Services to the maximum extent permitted by law.
- If you fail to pay for the services provided by third parties such as car park operators in full on or before the due date, we may charge you a late fee (the greater of $10 or other amount agreed with you).
- We will only provide the Services to you where you have paid for the services provided by third parties such as car park operators in full. Without prejudice to our other rights and remedies under this agreement, if any sum payable is not paid on or before the due date, we reserve the right, at our discretion, to suspend the provision of Services to you until we receive the required payment (including any late payment fees, interest, debt recovery charges and reactivation fees) in full.
- If you fail to make payment in accordance with the terms of this agreement, you will become liable for any reasonable costs incurred by us in recovering the debt (including any legal fees, collection agency charges or any other reasonable costs) and interest on the outstanding amount, calculated at the daily rate of 10% per annum, from the due date of the payment.
- Upon registration of a credit card account, you give us authorisation to debit your credit card for all charges.
- You consent to us obtaining a report from a credit reporting agency on your credit worthiness if you choose to pay by credit card.
- If we receive notice of a chargeback, declined or reversed payment from a credit card company in connection with payments made by you for the Services, we reserve the right to suspend the provision of Services to you until we receive the required payment (including any bank charges we incur, late payment fees, interest, debt recovery charges and reactivation fees) in full.
- There is no extra charge / additional premium applied on top of the prices / fees charged by third parties (such as car park operators) to the user. For example, rates for car parking are at the rates as advertised / displayed or charged by the car park operator.
9. The Use of Spam and Virus Filters
- We can use spam and virus filters and, to the maximum extent permitted by law, this may require us to use third party equipment or services to monitor and filter email traffic between our equipment and the Internet. To the maximum extent permitted by law, we will not be liable for any loss or damage resulting from the use of spam or virus filters.
10. Ownership of Equipment
- You obtain no rights to the hardware and other infrastructure and facilities used by us to deliver the Services.
- If we supply you with any equipment as part of our provision of the Services to you, unless the law otherwise requires, we do so on the following terms:
- You acknowledge that we are only acting as a reseller of the equipment which was manufactured by a third party;
- You will not resell, export or otherwise transfer the equipment;
- We are not obliged to keep the equipment current, up-to-date, in good working order or to alter or modify the equipment in any way;
- Any malfunction or manufacturer’s defect in the equipment must be remedied by you directly with the manufacturer and we are not liable for any such malfunction or defect or any consequences arising from them.
11. Intellectual Property
- All right, title and interest in any technology, techniques, software or trade mark that is used in, or provided by us, as part of the Services is owned by us or will vest in us on creation, or is licensed to us. You may use the technologies, techniques, software and trade marks as permitted by this agreement. We otherwise reserve all rights in relation to them.
12. Severability
- If any clause of these terms and conditions is held to be invalid or unenforceable in whole or in part, the invalid or unenforceable wording may be severed from this agreement and the remaining terms of this agreement continue in force.
13. Assignment
- You must not assign or otherwise transfer your rights or obligations under this agreement without our prior written consent, which may be withheld in our absolute discretion.
- We may assign or otherwise novate or transfer our rights and obligations under this agreement to:
- a related body corporate, including without limitation as part of a change in how we provide the Services or as part of a partial or full restructuring of our business; and
- another person as part of the sale, or restructuring, of all or part of our business, and you agree that, if we do this, we may transfer all necessary information (including, without limitation, personal information and credit card details) to the related body corporate or other person, and they may use that information, in order for them to be able to continue providing the Services to you. If you do not agree to the assignment, novation or transfer, you may terminate this agreement and we will refund any remaining unused credit on your account.
14. Changes to Terms
- We may change the terms and conditions of this agreement (including our Acceptable Use Policy and Privacy Policy) at any time. Details of our current terms will always be available on our website. Changes to this agreement will become effective upon their publication on our website and your use of the Services following publication of any amended version of this agreement will constitute acceptance of the amended terms. If you do not wish to accept the amended terms and conditions, you may terminate this agreement by contacting our ZipBy Support Service by:

15. Entire Agreement
- These terms and conditions constitute the entire agreement between us and you. It supersedes all prior agreements, understandings and representations whether oral or written.
16. Governing Law
- These terms and conditions are governed by the laws in force in New South Wales, Australia. Both parties agree to submit to the non-exclusive jurisdiction of the Courts of New South Wales, Australia.
17. Notifications & Communications
- All notifications under this agreement will be by email to your nominated internet address. This includes critical service notifications, renewal, billing and account notifications, scheduled downtime notifications, or any other communications deemed to be an essential part of our Service to you.
18. Privacy Policy
- We collect and use personal information in accordance with our privacy policy (available on our website at https://zipby.app/privacypolicy).
19. Acceptable Use Policy

- Our Acceptable Use Policy (set out in this clause 19) outlines what we deem to be unacceptable use of the Services.
- You must comply with our Acceptable Use Policy whilst using our Services and you must ensure that any person who you allow to use our Services also complies with this Acceptable Use Policy.
- We may change the terms and conditions of this Acceptable Use Policy at any time. Details of our current Acceptable Use Policy will always be available on our website. Changes to this Acceptable Use Policy will become effective upon their publication on our website and your use of the Services following publication of any amended version of this agreement will constitute acceptance of the amended terms. If you do not wish to accept the amended terms and conditions, you may terminate this agreement by contacting our ZipBy Support Service by:

- We will take reasonable measures to ensure that the owners and operators of our Services will comply with this Acceptable Use Policy.
- We reserve the right to monitor your compliance by any lawful means and to take action if we (in our sole discretion) deem it necessary. We will also investigate and, if appropriate, act on any complaint from a complainant. We will cooperate fully with law enforcement agencies if required by law.
- You must comply with all applicable Commonwealth, State and Territory laws. You must not act or fail to act in a way that would place us in breach of any applicable law, including those that regulate the provision of internet and telecommunications-related services.
- We impose additional restrictions on the use of our Services to ensure that our Services operate fairly for all customers and to safeguard our name, goodwill and reputation.
- You must not use our Services, attempt to use a Service, or allow a Service to be used in any way that:
- results in the customer or us breaching, or being involved in a breach of law, order, code, instrument or regulation;
- stores, sends or distributes any content or material which is restricted, prohibited, or is otherwise unlawful under any applicable Commonwealth, State or Territory law;
- is obscene, defamatory, offensive, abusive, sends, displays, accesses, makes available, publishes, or distributes or otherwise is involved in making material available that a reasonable person would consider obscene, defamatory, threatening, abusive, inciting of violence or hatred, or offensive;
- violates a person’s privacy;
- infringes on any person’s rights (including intellectual property rights and moral rights);
- constitutes a misuse of any person’s confidential information; or
- results in a breach by a customer of any obligation that the customer owes to any person;
- manipulates or bypasses our usage limits;
- impedes or interferes with our ability to provide our Services;
- damages our commercial well being, reputation or brand;
- would result in an excessive load being generated on our servers, network, or other resources; and would create any undue burden on other our customers or the Service in general.
Exceptions and exclusions may be granted at our discretion.
- To the extent permitted by law, we reserve the right to decide whether any action or omission constitutes unacceptable use and our decision will be final.

Nevertheless, we reserve the right to suspend or terminate a customer’s account without notice to that customer if the circumstances dictate (in our sole discretion) that immediate action is required.
- We may comply or cooperate with law enforcement and security agencies through any means we consider lawful, including in relation to court orders for the interception or monitoring of our Services.
- To the maximum extent permitted by law, we will not be liable for any loss a customer may suffer or incur if we suspend or terminate a customer account under the terms of this Acceptable Use Policy where:
- a customer has breached the terms of this Acceptable Use Policy;
- we are required to do so by law;
- we are directed to do so by the police or any governmental authority;
- we are entitled to suspend or terminate the customer account in accordance with our terms and conditions or Acceptable Use Policy; or
- we acted reasonably in the circumstances.
- Each customer agrees to indemnify us against any claim a complainant might make for any loss or damages the complainant incurs as a result of a breach of this Acceptable Use Policy by that customer.
- Each complainant agrees to indemnify us against any claim a customer might make for any loss or damages the customer incurs as a result of a complaint made by the complainant and the action we take as a consequence of that complaint, except to the extent that the acts or omissions of the customer contributed to the customer’s loss or damages.
20. Complaints process
Subject to clause 20.2, complaints about a customer of ours should be sent to support@zipby.app.
- If you have a complaint about content accessible using our Service, you may contact the Australian Communications and Media Authority in accordance with the complaints process detailed on their website: www.acma.gov.au.
- If we receive a complaint about a customer, we may refer it to the appropriate government agency or authority for action (which may include the Australian Federal Police, the Office of the Australian Information Commissioner (Privacy Commissioner), Australian Competition and Consumer Commission, or Australian Communications and Media Authority).
- Where we receive a complaint, the complaint will be acknowledged within 1 business day. The acknowledgment may be verbal (via telephone) or in writing (via email or letter) at our discretion.
- Where we receive notice of a complaint from a government agency or authority, we will, where appropriate and lawful, follow the procedures or take the actions we are required to take in that notice, including suspending or terminating your account, removing or disabling access to content or material, or providing the information requested by the agency or authority.
- If the complaint is about Service interference created by another customer:
- We will investigate the allegations and attempt to resolve the matter. If our Service is seriously compromised, we may choose to suspend a customer’s Service immediately pending an investigation.
- Our decision regarding Service interference will be final. It may include suspension or termination of a customer’s Service.
- We aim to resolve all complaints within 10 business days from the date of our acknowledgment of receipt of the complaint. However, it is not always possible to resolve complaints within this timeframe, and timeframes will vary depending on the nature of the complaint. We will keep complainants and relevant customers advised of progress in resolving any complaint raised with us, and we will advise both parties either verbally or in writing of the outcome of the complaint.
